Cup and handle should form at the bottom of a trend, this is half-way up so I don't personally see it as a true cup and handle.

They perform best when they come at the bottom of a trend,but still generally a bullish looking pattern when formed in other areas.When it forms mid way up a trend it could be seen as other patterns .Not as reliable as when it appears at the bottom.
